Terms of service
**ONLINE STORE TERMS AND CONDITIONS**
The owner of the online store www.deluxestore.ee (hereinafter referred to as the Online Store) is OÜ KM Deluxe (registration code 14363864), located at J. Koorti tn 8-2.
**Validity of the Sales Contract, Product and Price Information**
These terms and conditions apply when purchasing goods from the Online Store. The prices of the products sold in the Online Store are indicated next to the products. A delivery fee will be added to the price of the goods. All prices of goods sold in the Online Store are in euros.
The delivery fee for the goods depends on the buyer's location and the delivery method. The delivery fee will be displayed to the buyer when placing the order. Information about the goods is provided directly next to the product in the Online Store.
**Placing an Order**
To order goods, the desired products must be added to the shopping cart. To complete the order, the required fields must be filled out, and a suitable delivery method must be selected. The total cost will then be displayed on the screen, which can be paid securely through the following payment methods:
- Estonian bank payments: Swedbank, SEB, Luminor, LHV, Coop Pank, Citadele
**Note:** When paying via bank link, be sure to click the "Return to Merchant" button on the bank's page.
Payments are processed by Maksekeskus AS. Payment takes place outside the Online Store in a secure environment—when paying via bank link, in the corresponding bank's secure environment, and when paying by credit card, in the secure environment of Maksekeskus AS. The seller does not have access to the customer’s bank and credit card information. The contract becomes valid upon receipt of the payment due to the Online Store's bank account.
The owner of the Online Store is the data controller and forwards the necessary personal data for payment processing to the authorized processor, Maksekeskus AS.
If the ordered goods cannot be delivered due to stock shortages or other reasons, the buyer will be informed as soon as possible, and the paid amount (including the delivery costs) will be refunded without delay, but no later than 14 days from the notification.
**Delivery**
Goods are sent to the following countries: Estonia.
The buyer has the following options for receiving the goods: Omniva parcel machines, Smartpost parcel machines.
The shipping costs are borne by the buyer, and the relevant price information is displayed next to the delivery method.
Domestic shipments generally reach the buyer’s specified destination within 1-3 working days from the conclusion of the sales contract. In exceptional cases, the right to deliver the goods may extend up to 45 calendar days.
**Right of Withdrawal**
After receiving the order, the buyer has the right to withdraw from the contract concluded in the online store within 14 days.
The right of withdrawal does not apply if the buyer is a legal entity.
To exercise the 14-day right of return, the ordered goods must not be used in any way other than what is necessary to verify the nature, characteristics, and functioning of the goods, as allowed for testing the goods in a physical store.
If the goods have been used for purposes other than what is necessary to verify their nature, characteristics, and functioning, or show signs of use or wear, the Online Store has the right to reduce the refund amount according to the decrease in the value of the goods.
To return the goods, a withdrawal request must be submitted, and it should be sent to the email address km.deluxestore@gmail.com no later than 14 days after receiving the goods.
The Online Store has the right to withdraw from the sales transaction and demand the return of the goods from the buyer if the price of the goods in the online store has been marked significantly below the market price due to an error.
**Right to Claim**
The Online Store is responsible for any non-conformity or defect in the goods sold to the buyer that was present at the time of transfer of the item and becomes apparent within two years from the transfer of the goods to the buyer. Within one year from the transfer of the item to the buyer, it is presumed that the defect was present at the time of transfer of the item. The Online Store has the obligation to disprove this presumption.
In case of a defect, the buyer has the right to contact the Online Store no later than two months after the defect appears by sending an email to km.deluxestore@gmail.com or by calling +3725536317.
The Online Store is not responsible for defects that occur after the goods have been transferred to the buyer.
If the goods purchased from the Online Store have defects for which the Online Store is responsible, the Online Store will repair or replace the defective goods. If the goods cannot be repaired or replaced, the Online Store will refund all fees associated with the sales contract to the buyer.
The Online Store will respond to the consumer's complaint in writing or in a form that allows for written reproduction within 15 days.
**Direct Marketing and Personal Data Processing**
The Online Store uses the personal data entered by the buyer solely for processing the order and sending the goods to the buyer. The Online Store forwards personal data to companies providing transport services to deliver the goods.
The Online Store will send newsletters and offers to the buyer's email address only if the buyer has expressed this wish by entering their email address on the website and indicated their desire to receive direct mail notifications.
The buyer can unsubscribe from email offers and newsletters at any time by informing us via email or by following the instructions included in the emails containing the offers.
**Dispute Resolution**
If the buyer has complaints regarding the Online Store, they should be sent to km.deluxestore@gmail.com or by calling +3725536317.
If the buyer and the Online Store cannot resolve the dispute through agreement, the buyer can turn to the Consumer Disputes Committee. The procedural conditions can be found and an application can be submitted here. The Consumer Disputes Committee is competent to resolve disputes arising from the contract concluded between the buyer and the Online Store. The examination of the buyer's complaint in the committee is free of charge.
The buyer may also turn to the European Union's platform for resolving consumer disputes.
